AstraZeneca has agreed to pay about $2 billion in a settlement to settle allegations that it paid kickbacks to kick off patent litigation to drug maker Teva Pharmaceutical Industries.
The deal is a major step in the ongoing battle against generic drugmakers, who were accused of failing to protect patents protecting their patents for Pfizer’s Lipitor and AstraZeneca’s Zocor.
“This settlement is a major step in the fight against the generic companies,” said Sanjay Gupta, the company’s senior vice president for corporate affairs.
“The deal will help us secure billions of dollars in settlements, and I am confident it will also help us resolve the ongoing litigation and prevent serious consequences for our business,” Gupta added.
Teva Pharmaceutical Industries will pay $500 million to settle a lawsuit filed in March by the United States’ largest generic drug maker, AstraZeneca, which alleges that it illegally paid kickbacks to kick off patent litigation related to Crestor, an ulcer drug that is approved for use in older adults.
The $2 billion in settlements are part of a long-term commitment to the settlement that also includes a $250 million payment by the US Food and Drug Administration to a former Pfizer executive who died after being diagnosed with cancer. Pfizer denied a similar $1 billion payment to the maker of Lipitor, saying that it was “not a party to any litigation” and that the company would pay no more than $1 billion to Pfizer.
The United States has a patent on AstraZeneca’s Zocor that states that it can be used to prevent heart attacks and strokes, but that it is not used to prevent heart disease. Pfizer is the first generic drug maker to launch a generic version of the drug and it will be the first to do so.
The agreement will help Teva pay $1 billion to resolve a lawsuit filed in May by a family of generic drugmakers who allege that Pfizer paid kickbacks to kick off the patent in a deal that the company was successful with Teva. The lawsuit claims that Pfizer paid a portion of the kickbacks and that the company violated its patent on Lipitor.
The suit also seeks to prevent generic drugmakers from offering to pay off patents to their top partner, AstraZeneca, for a version of a cheaper generic version of Pfizer’s drug, Nexium.
The settlement resolves allegations that Teva, AstraZeneca and the other companies that made the agreements pay kickbacks to the company in exchange for allowing them to continue to market the drug and to sell its generic version.
